GENERAL CONDITIONS1.1. PAYUK DMITRY ZINOVIEVICH is the Individual Entrepreneur and Auction organizer, hereinafter referred to as "Organizer" or Auction House "Vinyl Bazar". Trades are processed virtually through the Internet at www.vinylbazar.com (henceforth "website").1.2. The Auction House "Vinyl Bazar" in its activities is guided by these rules and regulations and the current legislation of the Russian Federation.1.3. The Auction House acts as an agent of the Seller. The agent acts on his own behalf and at the Seller's expense.1.4. The participant at the auction may be capable individual who have reached the age of 18, or legal entities hereinafter referred to as the "Participants".1.5. These regulations apply to all aspects of the Organizer and Participants interactions that relate to purchases, sales, valuation, cataloging and maintaining.1.6. Any and all amendments to these regulations are valid when made in writing and signed by both Parties.
REGISTRATION2.1. The Buyer’s registration as Participant is the condition for purchasing items through the Organizer. Registration is free of charge and is required only for bidding. Registration signifies full agreement with the rules of participation in the auction and is based on Art. 438 Civil Code of the Russian Federation.2.2. Registration is done on the Website page (Login-Registration). The registrant must indicate the name, surname, e-mail and contact phone, as well as the system name and a password to access the auctions.2.3. Registration data is confidential and can be accessed only by the Organizer’sadministration and the Buyer himself. The password is specified at registration and can be changed at any time only by the Participant.
2.4. The personal data used at bidding will state the bet to belong to an individual of this personal data. In case there is a suspicion of third parties accessing the password the Participant must immediately contact the Organizer.2.5. Following the registration a confirmation letter will be sent to the e-mail address.2.6. The Organizer reserves the right to refuse the registration or participation in auctions without reasoning.2.7. The Auction House's representative has the right to request the potential bidder to provide: documents confirming the submitted identity, accounts statement and other financial documents confirming the auction the Participant's financial solvency.
THE AUCTION PROCESSING ORDER3.1. Auctions’ periods are indicated in the "Auction calendar” section, Moscow time.3.2. After the Auction starts, the catalog is published in the "Auction №" section and the admitted Participants can place bids.3.3. The Organizer places on website photographs and descriptions of actual lots, but it is strongly recommended to attend the pre-auction exhibition for direct review. The preauction exhibition periods are available on the Internet or by phone: +7(916)311-17-01; +7(499)745-07-99.3.4. Minimal lot’s bid augmentation:From 500 to 2 000 rubles: 100 rubles,From 2 000 to 5 000 rubles: 200 rubles,From 5 000 to 10 000 rubles: 500 rubles,From 10 000 to 20 000 rubles: 1000 rubles,From 20 000 to 50 000 rubles: 2 000 rubles,From 50 000 to 100 000 rubles: 5 000 rubles,From 100 000 to 200 000 rubles: 10 000 rubles,From 200 000 to 500 000 rubles: 20 000 rubles,From 500 000 to 1 000 000 rubles: 50 000 rubles,More than 1 000 000 rubles: 100 000 rubles.3.5. The Internet Auction is processed in the Online mode, the Auction's closing time is the time specified on the website in each lot's section. If the Participant bids on the lot less than 5 (five) minutes before the closing time the Auction's timer for the lot is automatically extended for 5 (five) minutes. Each particular lot's extention of time does not affect the closing time of other remaining lots.3.6. In case of technical problems caused by actions of third parties that affected the Website’s performance during the Auction's closing the Organizer reserves the right to cancel the Auction's results.3.7. The Organizer reserves the right to withdraw any lot from the auction at his discretion.3.8. Prices for lots are indicated in Russian rubles.3.9. Payment for the purchased lot ishall be made in Russian rubles.3.10. Russian is the official language of the auction.3.11. The Buyer wins the auction by placing the highest bid.
TRADES PARTICIPATION4.1. To enter the Internet Auction the potential Participant must register on the Website, provide Login and Password to access the current Auction or the particular lot.4.2. In order to bid on the lot the Participant needs to press the "Bid" button. Thus the articipant agrees to purchase the lot for the price that is indicated at the «Amount» input. The Participant can make any bid that exceeds the current price increment by selecting «Alternative bid» in the «Amount» input fbefore pressing "Bid" button.4.3. The Participant can submit the Offline bid with the function "Auto-bid" by specifying the amount in the corresponding field. Should this happen and at the Online Auction the Auto-bid service will automatically perform the minimum possible bids for the Participant up to submitted amount.4.4. All information on bids and lots is automatically reflected in the Participant's account "Favorites" section.4.5. The "Add to Favorites" button adds the lot page in the Participant's account «Selected lots» section. The Participant can submit bids from the «Selected lots» section.4.6. After the lot's closing time the Winning bidder receives an automatic notification to the e-mail address that was specified at Registration.
4.7. All the lots that were not sold at auction will be placed on the "AFTERSALE" page. It will open 1 hour after the end of the auction in the main menu. Lot in the "AFTERSALE" can be bought at the starting price. Commission to the price will also be 25%. Buyers who bought lots for "AFTERSALE" will receive separate invoices by mail.
PAYMENT PROCEDURE5.1. The Organizer's commission is 25% off the price at the auction. The payment must be completed within 7 (seven) business days since the auction is over.5.2. Available payment options:- payment in cash- electronic payment transfer- payment with credit card: VISA, VISA ELECTRON, MasterCard, MasterCard Electronic, Maestro, WORLD, JCB, UnionPay.The Invoice issued by Organizer according to the trade results serves as the basis for payment.5.3. In case no payment is completed by the Participant (winning bidder) within 14 (fourteen) business days since the auction is over, or no other payment due dates are agreed between the Participant and the Organizer a penalty of 300 rubles is charged for each extra day.5.4. In case of Participant's transaction refusal the Organizer reserves the right to: disallow the Participant in subsequent auctions, share the relevant information with other Auction Houses, demand a 25% penalty from the Participant off the purchase sum, apply to the court for moral and material damage compensation in accordance with the current Russian legislation.5.5. In case of Participant's transaction refusal the Organizer declares the lot’s trade void and, at his discretion, may expose the lot for subsequent auctions or return it to the Seller.
HANDING OVER6.1. The Participant can pick up the lot at the office or order a delivery. The Delivery is executed at the Buyer’s expense.6.2. Delivery is performed by the courier service "СДЭК". The Delivery is executed to the Named recipient only to any address in Moscow, Russian Federation or worldwide. The recipient pays for delivery to the courier upon receipt. You send a letter with the exact delivery address, we inform you the departure parameters (weight and cost). If everything suits you, then we issue an order in the company "СДЭК" and inform the order data (number and waiting period).
6.3. All items pending the shipment will be decently packed.
6.4. The lots may be handed over or shipped only when paid in full.
CONDITION AND AUTHENTICITY OF ITEMS7.1. The objects’ condition (vinyl records) is described only from visual criteria and characteristics according to a strict British assessment system (BAS).7.2. GUARANTEES8.1. Internet and Insite auctions processing is controlled by law firm.8.2. The Auction House "Vinyl Bazar" shall make all necessary arrangements to provide the reliable information on the exposed items.8.3. Items sold at auction are not refundable and exchangeable.8.4. The items (arts and autographs only) confirmed with expert assessment by the time of auction do not allow disclosing a statement of their possible forgery.8.5. The Paticipant must apply the statement on the purchased item's forgery within 6 (six) months since the date of auction and support it with at least two different independent expert reports issued by authorized organizations or experts.8.6. In case the item’s forgery is conclusively proven, it must be delivered to the Organizer in the same condition as it was sold on the day of auction, without any changes or interventions.8.7. The Organizer refunds such item to the Buyer as soon as the sum is received from the Seller who submitted the item for the auction.8.8. The refund guarantee is applied only directly to the Buyer that must be confirmed by the relevant documents. The returned item must be exempt from real obligations that the Buyer must also confirm.8.9. The Auction House "Vinyl Bazar" guarantees the confidentiality of information about the Buyer's name, location, the purchased lots and their value and all other personal data completed at registration.
